الملخص
ملخص: شهدت الجزائر على غرار باقي دول العالم تفشي وباء كورونا '' كوفيد 19 ''، ما أدى بالسلطة العامة لاتخاذ تدابير احترازية ووقائية للحد من انتشاره، بشل حركة النقل خارجيا وداخليا وغلق الحدود وحضر بعض النشاطات التجارية تنفيذا لتدابير الجحر الصحي تحت طائلة المتابعة الجزائية للمخالفين، إلا أن هذه التدابير من شأنها تعطيل الحياة الاقتصادية والتي لها انعكاس مباشر على الأمن القانوني في ظل الحجر الصحي والغلق المفروضين، حيث أن بقاء القواعد القانونية سارية المفعول والتطبيق الحرفي للمبادئ العامة لنظرية العقد في القانون المدني في هذا الظرف الاستثنائي سيؤدي إلى الإضرار بالذمم المالية للأشخاص وقد يؤدي إلى زوال كيانات برمتها، مما يستدعي تكييف الظرف وتفعيل أحكام قانونية من شأنها إعادة التوازن للرابطة العقدية. كلمات مفتاحية: تنفيذ العقد، كورونا كوفيد 19، الظروف الطارئة،الالتزام العقدي، ،توازن الالتزامات. Abstract Algeria, like the rest of the world, witnessed the outbreak of the Corona epidemic ‘’ Covid 19’’ which led the public authority to take precautionary and preventive measures to reduce its spread, paralyzing traffic externally and internally and closing borders and attending some commercial activities in implementation of health-care burrow measures under the penalty of follow-up of violators. The fact that the legal rules remain in force and the literal application of the general principles of contract theory in civil law at this exceptional juncture would prejudice the financial viability of persons and could lead to the disappearance of entire entities, requiring the adaptation of the circumstance and the application of legal provisions that would rebalance the contractual association.
