العرف اللغوي وأثره في فهم الخطاب الشرعي- دراسة دلالية تداولية -

الملخص
يتضمن هذا المقال بيان مفهوم العرف اللغوي وأثره في فهم الخطاب الشرعي، فأحكام التصرفات و صيغ العقود الناشئة بين الناس نحو "بِعْتُ واشْتريتُ وزوجت وطلقت،...وهي ما اصطلح عليه التداوليون بمصطلح الوعديات" تُفسر بمقاصد لغتهم؛ فالمتكلم عندما يتلفظ بجملة ما في مقام تواصلي معين فإنه ينجز أفعالا معينة من فعل اجتماعي، ففهم هذه الأفعال وتأويلها المنجزة يخضع لمعرفة صور مقاصد العرف كونه حاملا للمعنى المقصود. والخطاب الشرعي باعتباره خطاب تكليف نزل بلغة العرب، فإن من رام فهمه، يتطلب منه معرفة لغوية دقيقة بلغة العرب شكلا ومضمون وبأساليبها ومنحاها في كلامها، "إذ لا يستقيم للمتكلم في كتاب الله أو سنة رسول الله أن يتكلف فيهما ما لا يسعه لسان العرب". لذا سنحاول إبراز دور العرف في فهم الخطاب باعتباره آلية من آليات التأويل لفهم عملية التواصل. الكلمات المفتاحية: العرف اللغوي، القصدية، الحقيقة والمجاز، أفعال الكلام، التأويل. Abstract: This article includes a statement of the concept of linguistic custom and its impact on the understanding of the Sharia discourse. The provisions of the actions and forms of contracts that arise among people such as "I sold and I bought and I marry and I divorced What was named in Pragmatics by the term: "Commissive" can be explained by the purposes of their language. The understanding and interpretation of these acts is closely related to the knowledge of the purposes of the custom because it defines the intend meaning. The Sharia discourse as a charging discourse revealed in Arabic and who wants to understand it clearely It requires him to have accurate linguistic knowledge of the Arabic language in form and content and its styles "As it is not correct for the speaker in the Book of Allah or the Sunnah of the Messenger of Allah to claim what is not accepted by the Arabic language". So we will try to highlight the role of custom in understanding speech as a mechanism of interpretation to understand the process of communication.
