قيام المسؤولية عن الأعمال الصحفية للموازنة بين حرية الصحافة والتزامات المهنيين

الملخص
يسعى المشرعون لضبط الممارسة الإعلامية باطار قانوني باعتبارها مجالا مهنيا قد تنجم عنه جرائم، لكنهم أيضا وعملا بالمبادئ العالمية الداعمة لحرية الإعلام وحق المواطن في المعلومة يجدون أنفسهم أمام مهمة صون ما باتا يعرفان بمكسبين لا يمكن التنازل عنهما أي حرية الإعلام والحق فيه، وفي هذا الإطار اختلفت التوجهات التشريعية في نظرتها لحدود حرية الإعلام وكذلك في تفسيرها للمسؤولية القانونية ولقواعد القانون التي قد يدفع بها الصحفي لحماية نفسه من المساءلة كحق النقد ،وهو الأمر الذي استدعى نظرة فاحصة على أبرز هذه التوجهات وسندها الفكري والسياسي وبموازاة اهتمام المشرعين بمسؤوليات الاعلام، ظهر توجه يطالب بضبط الممارسة والمساءلة أيضا من قبل المهنيين أنفسهم عبر وضع مواثيق أخلاقية وانشاء هيئات تتابع مدى الالتزام بمبادئها انطلاقا من نظرية المسؤولية الاجتماعية، دون أن نغفل أنها استخدمت كذلك بغية قطع الطريق أمام التدخل الحكومي والقضائي الذي قد يحد من الحرية. Legislators are trying to organize media practices within a legal framework, considering it a profession that may result in crimes. But they, due to the international doctrines supporting the freedom of media and the right of people to get information, find themselves facing the task of preserving two irreversible gains; the freedom of information and the right to know. In this context different legislations have been developed when it comes to the limited of media freedom and also on the definition of legal liability and the rules of law which the media professionals can use to protect themselves from questioning, like the right of criticism. This required an in-depth approach on the most prominent of these legislations and on their basis, both political and ideological Along with the legislators’ concern on the responsibilities of media, appeared another trend calling for regulating the media practices and applying the roles of accountability. This was led by media people themselves through phrasing codes of ethics and establishing organizations that follow up the application of these codes of ethics. These were also used to prevent any governmental or judicial interference in the field of media that may curb the social freedoms.
