القضاء المستعجل في الصفقات العمومية في التشريع الجزائري

الملخص
ملخص إن الاستعجال في مادة الصفقات العمومية هو طعن قضائي يرفع أمام القاضي الإداري و يهدف إلى حماية مشروعية الصفقة العمومية ، بحكم قيامها على قواعد الإشهار و المنافسة بين العارضين، ذلك أنه لا حديث عن المنافسة إلا في ظل إشهار قانوني سليم ، وقد نظمه المشرع الجزائري بموجب أحكام المادتين 946 و 947 من قانون الإجراءات المدنية والإدارية، ولا يمارس هذا الطعن إلا في حالة خرق الأحكام المتعلقة بقواعد المنافسة والإشهار. Résumé Le référé relatif aux marchés publics est une voie de recours contentieux en matière administrative ouverte aux tiers à un contrat des marchés publics. Il s’applique conformément aux dispositions des articles 946 et 947 du code de procédure civile est administrative, en cas de manquement aux obligations de publicité et de mise en concurrence auxquelles est soumise la passation de certains contrats des marchés publics. Abstract Lawsuits concerning public procurement are not limited to their annulment according to the general rules; this lawsuit is instituted by the Algerian legislator under the provisions of articles 946 and 947 of the code of civil and administrative procedure under the name of summary judgment in the matter of contract and procurement conclusion.
