تعبير الإدارة عن إرادتها في إبرام الصفقات العمومية

الملخص
يمر تعبير الإدارة عن إرادتها في الصفقة العمومية بمجموعة من المراحل. فبعد الإعلان عن المناقصة تقوم لجنة فتح الأظرفة بتلقي العروض وتحضيرها؛ لتقوم بعد ذلك لجنة تقييم العروض، بدراسة العروض المقدمة دراسة دقيقة، بغرض القيام بإرساء الصفقة مؤقتا على المترشح الذي قدم أحسن عرض. وجدير بالذكر أن تعبير الإدارة عن إرادتها لا يكون نهائيا إلا باعتماد الصفقة من الجهات الإدارية المختصة قانونا بذلك. Résumé : L’expression de l’administration de sa volonté passe par plusieurs étapes. Après l’avis d’appel d’offre la commission d’ouverture des plis reçoit les offres, La commission d’évaluation étudié les offres pour attribué le marché au soumissionnaire présentant l’offre jugée le plus favorable. L’expression de l’administration de sa volonté n’est pas définitive qu’après son approbation par l’autorité compétente. Abstract: The expression of the consent of the administration in public procurement goes through several steps.The tender opening committee receives the bids, after the advertisement of the tender.The former committee examines the bids and attributes the public procurement to the tendered who presents the most favorable bid. The consent of the administration becomes final only when it is approved by the competent authority.
