تشغيل الأشخاص ذوي الإعاقة في إطار النسبة الإلزامية

الملخص
تزايد الإهتمام العالمي في الآونة الأخيرة بالتأكيد على ضرورة تمتع الأشخاص ذوي الإعاقة بجميع حقوق الإنسان وحرياته الأساسية، ومن ضمن هذه الحقوق الحق في التشغيل الذي يعزز شعور الشخص بقيمته الذاتية وبقدرته على المساهمة في المجتمع، لذلك عقدت المؤتمرات والندوات وتشكلت الجمعيات الدولية والوطنية للدفاع عن هذا الحق. وعليه نصت المواثيق الدولية على حق تشغيل الأشخاص ذوي الإعاقة، بقصد توفير المشاركة الكاملة لهم في الحياة الإقتصادية وعملية التنمية، إيمانا منها بالمساواة وتكافؤ الفرص ورغبة منها في حصول الشخص ذو الإعاقة على عمل مناسب يحفظ كرامته، ومن ثمّ إعادة إدماجه في المجتمع. ولضمان تشغيل الأشخاص ذوي الإعاقة أكدت التشريعات الوطنية في مختلف قوانينها على نسبة إلزامية واجبة التشغيل، كما أقرت عقوبات مختلفة على مخالفة هذه النسبة. In recent times, global concern has increased by emphasizing on the need to provide persons with disabilities by all principal human rights and liberties, and among this rights, we find the right to work which enhances the feeling of self-worth person and its capacity to participate in society. Consequently, conferences and symposiums had taking place and international and national associations for this right had been formed. In order to provide Persons with Disabilities with the full participation in economic life and development process, international conventions provided for their rights in employment, believing at equity and equal opportunities and providing the person with disabilities with a suitable work that preserves his dignity, and then comes his reintegration into society. To ensure the employment of persons with disabilities, national legislations insisted in their various laws for a mandatory proportion that should be employed, as well as they adopted various sanctions in case of violation of this proportion.
