ملخص: القيد في السجل التجاري وفي سجل الصناعة التقليدية والحرف إجراءا قانونيا إلزاميا، ويتوجب على كل شخص يمارس أو يرغب في ممارسة نشاط تجاري أو حرفي باسمه ولحسابه الخاص أن يقوم بالتصريح تحت مسؤوليته لدى هيئة إدارية رسمية مختصة، تمسك سجلا خاصا بذلك، وتتولى تدوين تصريحاته، تثبيتا للحقوق وحماية للمصالح. كما يعد القيد في السجل التجاري وسجل الصناعة التقليدية والحرف آلية ضبط وتوجيه ضرورية ، حيث يعتمد عليه في وضع إستراتيجية اقتصادية للدولة ومقياس تقاس به درجة تطور الاقتصاد الوطني ووسيلة قانونية لإضفاء الشرعية على الشخص الممارس لنشاط اقتصادي خاضع للقيد في أحد السجلين، إلى جانب ما يؤديه من وظائف مختلفة يمكن حصرها إجمالا في بعدين أساسيين هما، بعد ضبطي باعتباره أداة تنظيمية، إحصائية، رقابية لهذه لأنشطة بهدف خدمة الاقتصاد الوطني وتنميته وتطويره. وبعد توجيهي، كونه أداة قانونية، استعلاماتية واشهارية، لتجاوز بذلك كونه مجرد أداة إدارية إلى أداة تدخل اقتصادية تضبط الأنشطة الاقتصادية وتوجهها. The Commercial Register andthe Handicraft and CraftRegister as a Necessary Mechanism for Controlling and Directing Commercial and Craft activities The registration in the Commercial Register and in the Register of Handicraft Production and Crafts is a compulsory legal procedure. Any person who exercises or wishes to engage in a commercial or professional activity in his name and for his account must declare under his responsibility to the concerned official administrative body, that owes a register specific for that purpose and that takes a record of his declarations in order to preserverights and to protect interests. The aforementioned is familiar to people since ancient times under the Roman Empire under the so-called:System of Denominations. The registration in the Commercial Register and the Register of Handicraft Production and Crafts is regarded as a necessary control and guidance mechanism, which, based on that, the development of an economic strategy for the state is dependent. It is, also, a scale to measure the degree of development of the national economy, and a legal means to provide the person practicing in the economic activity subject to registration in one of the two registers with legitimacy. In addition to that, it has various functions that can be identified in two basic dimensions: a controlling dimension, by being a regulatory, statistical, supervisory and guiding tool for these activities in order to serve, develop and direct the national economy. , and a communicative dimension by being a legal, informational and advisory tool, to go beyondbeing merely an administrative tool to an economic intervention tool that regulates and directs the economic activities.
