أوجه الاختلاف في قطعية القواعد الأصولية

الملخص
ملخص : بنيت القواعد الأصولية على التقعيد الشرعي و الاستدلال المعتبر للمناسبات ، و أضحت عند فريق من الأصوليين قطعية تخرج عليها الفروع ، و قد قامت القطعية فيها من جهة الاستقراء و التواتر المعنوي و كثرة الاطلاع لمجموع الأدلة الشرعية ، و آثر فريق آخر منهم القول بالظن المعتبر لوقوع الاختلاف في الأخذ بها و لوجود ما يقدح اعتبارها من حيث موردها و ترتيب الأدلة قوة و ضعفا . إلا أن هذا الخلاف لا ينظر إليه من جهة الأثر الفقهي ، و إنما ينظر إليه من جانب اعتباري نظري مبني على اختلاف في الألفاظ و في اختلاف مسالك القطع و اختلاف المدارك .
