La Mise En Conformité Des Constructions Et Leur Achèvement : La Loi 08/15, Une Loi Inappliquée Ou Une Loi Inapplicable ?

Résumé
Dans le but de mettre un terme à l’anarchie urbanistique en Algérie, s’inscrit la loi 08/15 du 20 juillet 2008 fixant les règles de mise en conformité des constructions et leur achèvement. Elle permet la régularisation de la situation des constructions qui sont édifiées de manière anarchique et sans aucun document justificatif de propriété ou de permis de construire pour leurs propriétaires, ou ne possédant pas de certificat de conformité. Le présent article vise à avancer des éléments essentiels pour comprendre cette loi et son champ d’application. Il s’agit aussi tout particulièrement d’analyser les réalités de l’environnement dans lequel est conçue cette loi, de cerner de près les caractéristiques et les obstacles qui entravent son application. On a pris comme exemple la commune de Ferdjioua pour mieux démontrer l’opération de régularisation. En conclusion on essayera de connaitre les causes de non application de cette loi , d’apporter des solutions, d’émettre des suggestions et de proposer des recommandations permettant une meilleure application des dispositions de cette loi dans le futur proche. Abstract: In order to put an end to urban anarchy in Algeria, Law 08/15 of 20 July 2008 lays down the rules for the conformity of buildings and their completion. It permits the regularization of the situation of buildings without a certificate of conformity. The purpose of this article is to provide essential elements to understand this law and its scope. It is also a question of analyzing the realities of the environment in which this law is being drafted, and of identifying the characteristics and obstacles that impede its application. The example of the commune of Ferdjioua has been taken to better demonstrate the regularization operation. In conclusion, an attempt will be made to find solutions, to make suggestions and to propose recommendations for better implementation of the provisions of this law in the soon future. ملخص : من أجل وضع حد للفوضى والبناءات اللا شرعية وتصحيح الوضعية العمرانية في الجزائر،جاء القانون 08/15 المؤرخ 20 جويلية 2008 الذي يحدد قواعد مطابقة البنايات وإتمام إنجازها. حيث كان الهدف منه السماح بتنظيم حالة الإنشاءات التي يتم بناؤها بطريقة فوضية ودون أي أدلة أو سند قانونني على ملكيتها أو تصاريح بناء لأصحابها أو عدم تحصلها على رخصة بناء أو شهادة المطابقة. والغرض من هذه المادة هو توفير عناصر أساسية لفهم هذا القانون ونطاقه. وهي أيضا مسألة تحليل واقع البيئة التي يجري فيها صياغة هذا القانون، وتحديد الخصائص والعقبات التي تعرقل تطبيقه. وقد أخذت بلدية فيردجيوا كمثال لإثبات عملية التسوية بشكل أفضل. وختاما، سنحاول معرفة أسباب عدم تطبيق هذا القانون، وإيجاد الحلول، وتقديم الاقتراحات، واقتراح توصيات تسمح بتطبيق أحكام هذا القانون على نحو أفضل في المستقبل القريب.
