الملخص

ملخص : بالقيام بعملية مسح وقراءة متأنية للجهاز القانوني المسير للتعليم العالي في الجزائر، وتقييمه، منذ بداية الاستقلال الوطني إلى غاية الإصلاحات الأخيرة، يتجلى بوضوح أنه كان، في مجمله، متدرجا ومتجانسا ومتكاملا، من حيث الأحكام الداعية إلى الإسهام الفاعل في التنمية الوطنية. وبالمقابل، فإن جل النصوص القانونية، المتعلقة بالتنمية، لم تتعرض في أحكامها ولا في تأشيراتها (مقتضياتها) إلى قطاع التعليم العالي، باعتباره أهم قطاع مغذي بالكفاءات والمهارات للمجال التنموي الاقتصادي، ومن ثمة، يستنتج أن ليس هناك انسجام وتنسيق وتناغم على المستوى التشريع المنظم لهذين القطاعين. وعليه، يتعين تركيز الاهتمام على التنسيق الوثيق والتشاور المستمر، مع القطاعات المعنية، عند إعداد النصوص القانونية، بغية توفير الشروط المواتية للإعمال الناجع للسياسة المعتمدة في مجال تحقيق التنمية المنشودة. Abstract : A study combined with an evaluation of the legal framework governing higher education in Algeria, since national independence until the last reforms, clearly demonstrate that the latter was, as a whole, gradual, harmonious and homogeneous, given its provisions which encourage an active contribution to national development. However, the majority of development-related legal texts do not mention, in their provisions or visas (considerations), the higher education sector, even though it is the provider of skills and talents necessary for economic development. This means that there is no harmony, coordination or synergy in terms of legislation governing these two sectors. Therefore, attention should be focused on close coordination and continuous consultation with the relevant sectors, when drafting legal texts, in order to create the conditions for the efficient implementation of the policy adopted for the realization of expected development.
