جبر أَضرار الضحايا أمام المحاكم الجنائية الدولية والمختلطة

الملخص
ملخص: يهدف هذا البحث إلى التأكيد على أهمية العدالة التعويضية بالنسبة لضحايا الجرائم الدولية في إطار العدالة الجنائية الدولية وتحديد مختلف العقبات والعراقيل التي يواجهونها خلال سعيهم للحصول على جبر الضرر. وهذا من خلال تسليط الضوء على كيفية تعامل المحاكم الجنائية الدولية والمختلطة مع مسألة جبر أضرار ضحايا هذه الجرائم، وعلى التطورات الحاصلة في هذا المجال. وقد انتهى هذا البحث إلى جملة من النتائج أبرزها أن حق الضحايا في المشاركة في الإجراءات والحصول على التعويضات قد تم تكريسه في إطار العدالة الجنائية الدولية الحديثة، كما خلص كذلك إلى أن العقبة الأبرز التي تواجه برامج التعويض والجبر هي مشكلة التمويل أو الموارد المالية اللازمة لتنفيذها. Abstract: This research aims to emphasize the importance of reparative justice for victims of international crimes within the framework of international criminal justice and to identify the various obstacles and impediments they face as they seek reparation. This is by shedding light on how international and mixed criminal courts deal with the issue of reparation for victims of these crimes, and on the developments taking place in this field. This research concluded with a number of results, the most notable being that the right of victims to participate in procedures and obtain compensation has been established within the framework of modern international criminal justice. It also concluded that the most prominent obstacle facing compensation and reparation programs is the problem of funding or resources necessary to implement them.
