التحقيق التكميلي في المواد الجزائية

الملخص
الملخص: إن التحقيق التكميلي إجراء من الإجراءات التي تلجأ إليه الجهات القضائية الجزائية سواء على مستوى التحقيق أو على مستوى المحاكمة، إذ خول المشرع الجزائري غرفة الاتهام وحدها في مرحلة التحقيق صلاحية الأمر بإجراء تحقيق تكميلي بتكليف قاضي منتدب للقيام به دون قيام الغرفة به مجتمعة، بخلاف قاضي التحقيق الذي لم يمنح سلطة اتخاذ مثل هذا الإجراء، وذلك احتراما لمبدأ حياد القضاء. كما يحق لبعض جهات الحكم سلطة اللجوء للتحقيق التكميلي؛ حيث يعتبر من الإجراءات التحضيرية الاختيارية التي يقوم بها رئيس محكمة الجنايات، وكذا قاضي محكمة الجنح الذي يتولى بنفسه إجراء التحقيق التكميلي وبموجب حكم قبل الفصل في الموضوع، كما يقوم بهذا الإجراء أيضا قاضي محكمة المخالفات نفسه. ولم يكتفي المشرع بذلك، بل الأكثر من ذلك أنه خول قسم الأحداث بمقر المجلس القضائي الذي أحيلت إليه الجريمة الموصوفة جناية الأمر بصفة جوازية بإجراء تحقيق تكميلي مسبق قبل الفصل في القضية، ويندب لذلك قاضي التحقيق المكلف بالأحداث. Abstract: The penal jurisdictions either on the level of investigation or on the level of trial, resort to complementary investigation, as the law maker has exclusively granted this prerogative to the investigation Chamber, via designating a delegate judge, unlike the investigative Judge who cannot legally perform this procedure, in accordance with the principle of neutrality. Some trial jurisdictions are also entitled to resort to complementary investigation, as it is considered an optional preparatory procedure that can be ordered by the Criminal Court, also, the misdemeanour Judge proceeds personally to complementary investigation in virtue of a rule before deciding on the subject-matter, the contravention tribunal performs the same procedure. In addition, the legislator has entitled the juvenile Chamber at the appeal Court to proceed optionally to an anticipated complementary investigation before ruling on the subject-matter, when an offence qualified as a crime is referred to it, an investigative Judge of minors is delegated to fulfil the task.
