الملخص
الملخص. تهدف هذا الدراسة والموسومة بعنوان مسؤولية دولة اسرائيل عن تعذيب الأسرى الفلسطينيين وفق أحكام القانون الدولي الإنساني إلى بيان كيف قامت دولة الاجتلال بانتهاك الحقوق الأساسية للإنسان ومخالفتها لاتفاقيات جنيف وملاحقها، ومخالفتها لأحكام اتفاقية مناهضة التعذيب. واختتمت الدراسة بخاتمة تكتنف العديد من النتائج أهمها رغم انضمام دولة الاحتلال لاتفاقية مناهضة التعذيب وإلى اتفاقيات جنيف الأربعة إلا أن اسرائيل لم تقم بمواءمة تشريعها الجنائي بأي مواد قانونية لمنع وتجريم التعذيب، والعديد من التوصيات أهمها ضرورة قيام المستوى الرسمي الفلسطيني والمؤسسات الأهلية الحقوقية والقانونية باستخدام الآليات المقررة بموجب أحكام القانون الدولي لإجبار دولة الاحتلال بتجريم التعذيب، وعقد المؤتمرات الدوليه بهذا الخصوص، ومحاولة تدويل قضية الأسرى الفلسطينيين والعرب، والعمل على توحيد الجهود الفلسطينية والعربية لحصر انتهاكات اسرائيل ومخالفتها لاتفاقيات جنيف الاربعة، ولاتفاقية مناهضة التعذيب. Abstract: This study, entitled The State of Israel's Responsibility for the Torture of Palestinian Prisoners in accordance with the Provisions of International Humanitarian Law, aims to show how the State of Israel has violated fundamental human rights, violated the Geneva Conventions and their annexes, and violated the provisions of the Convention against Torture. The study concluded with a conclusion beset by many results, the most important of which is that despite Israel's accession to the Convention against Torture and the four Geneva Conventions, Israel has not harmonized its criminal legislation with any legal articles to prevent and criminalize torture, and many recommendations, the most important of which is the need for the Palestinian official level and civil human rights and legal institutions to use the established mechanisms. Under the provisions of international law to force Israel to criminalize torture, to hold international conferences in this regard, to try to internationalize the issue of Palestinian and Arab prisoners, and to work to unify Palestinian and Arab efforts to limit Israel's violations and violations of the four Geneva Conventions and the Convention against Torture.
