حقوق الإنسان في ظل جائحة كورونا: " دراسة الثابت والمتغير فيها على ضوء النصوص التنظيمية في الجزائر"

الملخص
ملخص: إن ظهور جائحة كورونا قد خلق أزمة صحية عالمية، دفعت بدول العالم إلى انتهاج تدابير استعجالية واستثنائية عصفت ببعض حقوق الإنسان وأهمها حرية التنقل وحرية التواصل والاجتماع مع الغير، وعلى الرغم من شدة التدابير الاستعجالية المتخذة في زمن جائحة كورونا، ظلت تقارير منظمة الصحة العالمية تشير إلى العجز المؤقت لها، مما دفعنا كباحثين في مجال القانون لتساؤل عن الثابت والمتغير في مجال حقوق الإنسان أثناء جائحة كورونا وفي ضوء التدابير الإستعجالية المتخذة وقتها، وعليه نهدف في هذا المقال إلى تسليط الضوء على نوع التدابير الاستثنائية في مجال جائحة كورونا أولا، ثم تحديد طبيعتها القانونية وقيمتها التشريعية ومدى تأثيرها على حقوق الإنسان ثانيا. الكلمات المفتاحية: الحقوق، الإنسان، كورونا، الوقاية، الحجر، الطوارئ، التعليمات. Abstract: The emergence of the COVID-19 pandemic has created a global health crisis, pushing countries around the world to adopt urgent and exceptional measures that have impacted certain human rights, most notably the freedom of movement, freedom of communication, and the freedom to gather with others. despite the severity of the emergency measures taken during the COVID-19 pandemic, reports of the world health organization have consistently highlighted its temporary shortfall. This has led us,as researches in the field of law, to question the constant and variables in the field of human rights during the COVID-19 pandemic and in light of the emergency measures taken at that time. Therefore, the aim of this article, to shed light, first, on the nature of exceptional measures during the COVID-19 pandemic, and second, to determine their legal nature, legislative value, and their impact on human rights.
