التأسيس القانوني للملحق في الصفقات العمومية بموجب نظرية عمل الأمير - دراسة على ضوء القانون الإداري .

الملخص
تلجأ الإدارة العامة إلى إبرام الملحق لأية صفقة عمومية تحتاج للتعديل بسبب الظروف الطارئة، ويثار التساؤل عن إمكانية إنشاء ملحق لصفقة عمومية تحتاج للتعديل بسبب إدخال تحسينات تقنية على مشروع الصفقة، وهو ما سيتم بحثه في هذا المقال المعنون بـ : التأسيس القانوني للملحق في الصفقات العمومية بموجب نظرية عمل الأمير:ّ دراسة على ضوء القانون الإداري؛ حيث يهدف البحث إلى بيان إمكانية إنشاء ملحق بموجب نظرية عمل الأمير بسبب إدخال تحسينات تقنية على مشروع الصفقة العمومية، وقد تم التوصل إلى أن نظرية عمل الأمير قوامها شرط وجود العقد الإداري، والملحق هو الآخر وثيقة تعاقدية تابعة للصفقة العمومية التي تعتبر عقدا إداريا تظهر فيه المصلحة المتعاقدة بمظهر السلطة العامة، وبالتالي فإن هذا الشرط الذي تعتمده نظرية عمل الأمير يجعل هذه الأخيرة أساسا لمشروعية الملحق الذي ينشأ بمناسبة إدخال تحسينات على الصفقة العمومية. Abstract: The public administration resorts to the conclusion of the attachement for any public deal that needs to be modified because of the emergency circumstances , and the question arises about the possibility of creating an appendix to a public deal that needs to be modified due to the introduction of technical improvements to the draft of the deal, which will be discussed in this article entitled : « The legal establishment of the supplement in public deals (procurements) according to the Prince s’ working theory », A study in the light of the administrative law , where the research aims to show the possibility of creating an appendix according to the « Prince' s work theory » due to the introduction of technical improvements to the public deal project , and it has been concluded that the « Prince's working theory » is based on the condition of the existence of the administrative contract, and the appendix is also a contractual document subordinate to the public deal which is considered an administrative contract in which the contracting interest appears in the appearance of public authority, and there for, this condition adopted by the « Prince ' s work theory » makes the latter a basis for the legality of the appendix that arises on the occasion of improvements to the public deal project.
