مجلس حقوق الانسان كآلية لإقرار الحق الإنساني في البيئة

الملخص
الحق الإنساني في البيئة هو أحد المفاهيم الأساسية الحديثة العهد وفتيّة النّشـأة التي اهتمّ بها المجتمع الدولي وفرض احترامها وعزّز تكريسها في الأنظمة الداخلية للدول، ولعلّ هذا الاهتمام لم يكن من فراغ وإنّما نتيجة لتمتّع الفرد بقدر أكبر من الحقوق والحريّات وضمانة للتأكيد على الحق الإنساني في البيئة، ولمّا كانت حماية البيئة تقع على عاتق الجمعية العامة للأمم المتحدة بالدّرجة الأولى فإنها أوكلت لمجلس حقوق الإنسان حماية حقوق الإنسان بشكل عام وحماية البيئة بشكل خاص، فظهر بذلك اهتمامه بإقرار الحق البيئي وفي سلامته واستدامته من خلال مجموعة القرارات التي أصدرها منذ نشأته. Abstract: The human right to the environment is one of the basic concepts of recent origin that the international community has paid attention to and imposed respect for and approved its enshrinement in the internal systems of states, and perhaps this interest was not out of thin air, but for the individual to enjoy a greater amount of rights and freedoms and a guarantee to emphasize the human right to the environment, and since the protection of the environment is one of the prerogatives of the UN General Assembly in the first place, it mandated the Human Rights Council to protect human rights in general and protect the environment in particular, thus showing its interest in approving The right to the environment, its safety and sustainability through the set of decisions it has issued since its inception.
