الملخص

عقوبة المخدرات في الفقه الإسلامي والقانون الأفغاني الملخص: لقد كرّم الله الإنسان وأعلى شأنه وأتم عليه نعمه ظاهرةً وباطنةً، وأحل له من الطيبات ما يحفظ عليه حياته، كما حرم عليه كل خبيث ضار بجسمه أو بعقله، ولقد اعتنى الإسلام بحفظ الضروريات الخمسة- الدين والنفس والعقل والنسل والمال- واعتبر الاعتداء على هذه الضروريات جريمة تستلزم عقابًا لأجل دفع الشر والفساد في المجتمع، ولا شك أن المخدرات هي الآفة الخطيرة القاتلة التي بدأت تنتشر في الآونة الأخيرة في كافة المجتمعات الإنسانية، وأصبحت خطرًا تهدد المجتمعات وتنذر بانهيارها، وتعد مشكلة المخدرات من أخطر المشاكل الصحية والاجتماعية والاقتصادية التي تواجه العالم، وهي تضعف إرادة الإنسان، وتذهب بعقله، وتدفعه في أخف الحالات إلى ارتكاب الموبقات، ولذلك منعت الشريعة الإسلامية والقوانین الوضعیة جميع صور إنتاج المخدرات واستعمالها وتجارتها وترويجها وتهريبها وكافة التعاملات المختلفة بها، فشرعت العقوبة في هذه الدنيا لتمنع الناس من ارتكاب الجرائم والمعاصي لأن الأمر والنهي فقط لايكفي للوقوف على حدود الله، ولولا العقوبات لاجترأ الناس على ارتكاب المحرمات والجرائم، واعتبرت هذه العقوبة إصلاحًا وزجرًا للمجرمين، ولا خلاف بين الفقهاء أن عقوبة إنتاج المخدرات وترويجها وتهريبها واتجارها عقوبة تعزيرية وتفويضية للإمام، فقد فوض الشارع الحكيم تحديدها للاجتهاد التشريعي والقضائي، وإن اختلفوا في عقوبة استعمالها، ومع ذلك قامت جمهورية أفغانستان عبر مؤسساتها بتشريعات عديدة لمواجهة مشكلة المخدرات، وصرحت على منع جميع طرق استعمال المخدرات والتعامل بها، فوضعت قوانين رادعة وصارمة لاجتثاث جذور هذه الظاهرة الخطيرة. الكلمات المفتاحية: المخدرات، العقوبة، الفقه الإسلامي، القانون الأفغاني. Abstract: Almighty Allah SWT has honored the human being, his blessings, both outwardly and inwardly, permitted him to recruit good things, and has forbidden him to every evil harmful to his body or mind. Indeed, Islam has taken care of preserving the five necessities—religion, soul, mind, generation, and wealth. Also, criminalized anything threatens these necessities to ban the evil and corruption in society, and there is no doubt that drugs are a dangerous and deadly scourge that has recently started spreading in all human societies, and has become a threat that threatens societies. Likewise, the drug problem is one of the most serious health, social and economic problems facing the world, and it weakens the will of a person goes with his mind and drives him in the slightest of cases to committing transgressions, and that is why Islamic Sharia and statutory laws forbid all forms of drug production, use, trade, promotion, smuggling and all the various dealings with it. Therefor the punishment was prescribed in this world to prevent people from committing crimes and sins because only the order and the prohibition are not sufficient to stand On the limits of Allah, and if it were not for the punishments, people would have dared to commit forbidden and crimes, and this punishment was considered a reform and a curse for criminals, and there is no dispute between For jurists that the punishment for drug production, promotion, smuggling and trafficking is a discretionary and discretionary punishment for the Muslim Ruler, the wise lawmaker has delegated its determination to the legislative and judicial jurisprudence, even if they differed in the punishment for their use.
