الملخص

الملخص : ما قرأناه في الروايات الأدبية المترجمة إلى أفلام علمية خيالية، أصبحنا نعيشه الآن حقيقة بفعل التطور المتلاحق للذكاء الاصطناعي ، بحيث أصبحت له إمكانيات متطورة ورهيبة تسمح له بالتصرف بتلقائية ودون الحاجة إلى البشر، هذا ما يقلل من إمكانية التحكم في تصرفاته وما يتبع ذلك من مسؤوليات. بالإضافة إلى التعدي على الحق في الخصوصية الذي يعتبر من الحريات الأساسية للمواطن، وذلك بسبب استعماله لبياناته الشخصية، فهل تدخل المشرع لتحديد المسؤولية القانونية لهذه الاستعمالات وتبعات ذلك؟ وعلى ضوء هذه المعادلة عملنا من خلال هذه الورقة البحثية على تسليط الضوء على حرية الفرد في استعمال الذكاء الاصطناعي من جهة، والخوض في المسؤولية القانونية والأخلاقية المترتبة عن ذلك الاستعمال من جهة أخرى. أين عملنا على تحليل الصعوبات التي تواجه المشرع لتجاوز النظريات التقليدية للمسؤولية المدنية والجزائية Abstract: What we once read in translated novels, into science fiction films, has now become a reality, due to the successive development of artificial intelligence, Its advanced and astonishing capabilities allow it to act autonomously without the need for human intervention, Which diminishes the possibility of controlling its actions and the subsequent responsibilities, Moreover, this poses a threat to the fundamental libertie of privacy for individuals as it involves the use of their personnel data. Does legislation step in to determine the legal responsibility for these uses and their consequences? In light of this equation, we conducted this research paper to shed light on individual liberties in using artificial intelligence on one hand, and to explore the legal and ethical responsibilities arising from such usage on the other hand, We analyzed the difficulties faced by lawmakers in overcoming the traditional theories of civil and criminal responsibility.
