الحق في الثقافة في التعديل الدستوري لسنة 2020

الملخص
تمحور موضوع هذا المقال في تناول حق من حقوق الجيل الثاني للإنسان، المتمثلة في الحقوق الاقتصادية والاجتماعية والثقافية، وهو الحق في الثقافة، والذي تمت دسترته في التعديل الدستوري لسنة 2016، وتم إعادة التأكيد عليه في التعديل الأخير لعام 2020. حيث حاولنا مكاشفة مضمون هذا الحق وأبعاده. وانتهت الدراسة إلى أن المشرع الدستوري قد حرص على ضمان هذا الحق الدستوري تعزيزا للإنتاج والإبداع الفكري، وحماية للتراث المشترك، وهو بذلك يؤسس لانفتاح الوثيقة الدستورية على كل ما هو كوني من جهة، واعتراف منه بدور هذا الحق في تحقيق استدامة التنمية والهوية. The subject of this article focused on addressing one of the rights of the second generation of human beings, represented in economic, social and cultural rights. It is the right to culture, which was constitutionalized in the constitutional amendment of 2016, and reaffirmed in the latest amendment of 2020, where we tried to show the content of this right and its dimensions. The study concluded that the constitutional legislator was keen to guarantee this constitutional right to enhance intellectual production and creativity, and to protect the common heritage, Thus, it establishes the openness of the constitutional document to everything that is universal on the one hand, and its recognition of the role of this right in achieving sustainable development and identity on the other hand.
