The International Protection Of Patents And Its Effects On The Algerian Legislation, The Internal Laws And The International (global) Conventions

Abstract

The present study tackles the issue of patent protection in the international legislation and Algerian law; whether there is a suitable environment for the owner of the invention to express his innovations with complete freedom and confidence without being subjected to violation. The patent is considered an intellectual property right, from which the inventor benefits financially and enriches the technical knowledge about economic, technological and cultural development, in exchange for preventing others from using or exploiting the profits of this innovation in deceitful ways. Therefore, international legislators seek to value the innovations, through making agreements; such as the TRIPS Agreement and the Paris Agreement of 1883, for the purpose of protecting them from harmful and abusive exploitation and expanding the scope of protection internationally. The Algerian legislator, in keeping with the global changes, approved this through the 03/07/2003 order concerning patents, which provided a full set of procedures for protecting the inventions, which were a subject of enrichment, in line with the technological and economic development that the world is currently experiencing.
