النَّفْي تَعْزِيراً فِي الفِقهِ الإِسلَامِيِّ والقَانُون Exile As A Ta’zir In Islamic Jurisprudence And Law

Abstract

من أهم العقوبات المشروعة في القضاء، في الفقه الإسلامي والقانون، هي عقوبة "النَّفْي تعزيرًا"، وتظهر مشكلة البحث في تصميم نظرية متكاملة لعقوبة النَّفْي تعزيرًا في الفقه الإسلامي، مقارنة بالقانون. وتهدف هذه الدراسة إلى بيان مفهوم التعزير وضوابطه ومشروعيته وأنواعه، ثم مفهوم النَّفْي تعزيرًا واستقراء الأدلة على مشروعيتة، وبيان أهم الصور التي قال فيها الفقهاء بجواز عقوبة النَّفْي للجاني تعزيرًا، مع المقارنة بالنَّفْي في القانون السوري، متبعاً المنهج التحليلي والمقارن. وانتهيت إلى عدة نتائج منها أن النَّفْي هو إبعادُ القاضي للجاني عن بلد الإقامة أو البلد الذي وقعت الجناية فيه، ويكون النَّفْي تعزيرًا بالإبعاد عن البلد إلى بلد آخر، مع وضع المنفي تحت المراقبة. وللقاضي حرية فرض عقوبة النفي تعزيرًا في الجرائم التي يرى من المصلحة فرضها فيها، للحفاظ على مقصد من مقاصد الشريعة، كحفظ الدين، أوحفظ العرض والأخلاق، أوحفظ العقل، أو المال والاقتصاد. Abstract: One of the most important legal penalties in the judiciary, in Islamic jurisprudence and law, is the punishment of " Exile as a ta’zir ". This study aims to clarify the concept of punishment, its controls, legitimacy and types, then the concept of banishment and extrapolation of evidence for its legitimacy, and to show the most important forms in which jurists said that the punishment of banishment is permissible for the offender, with comparison with banishment in Syrian law, following the analytical and comparative approach. And I concluded with several results, including that exile is the judge's removal of the offender from the country of residence or the country in which the felony occurred, while placing the exiled under surveillance. The judge is free to impose the penalty of exile as a ta’zir in crimes in which he deems it is in the interest to impose it, in order to preserve one of the objectives of the Sharia, such as preserving religion, preserving honor and morals, preserving reason, or money and the economy.
