الملخص
ملخص: الأطفالُ هم زينةُ الحياةِ الدنيا، وبناةُ الغَدِ الجَميل، فينبغي الاهتمام بهم وبحقوقهم، ومن ذلك حقهم في الرَّضَاع، ولهذا جاءت هذه الدراسة، وتكمن المشكلة البحثية في بيانِ حقِّ الطِّفْل في الرَّضَاعة، في الفقه الإِسلاميِّ والقَانون، والهدفُ من الدراسة هو بيان مفهوم حقِّ الطِّفْل، ومفهوم الرَّضَاع، ثم بيان أحكام رَضَاع الطِّفْل في الفقه الإسلامِيِّ، وبيان أحكام الرَّضَاع في القَانون، واستخدمتُ في الدراسة عِدَّة مناهِجَ علمية وهي: المنهج التحليلي، والمنهج الفقهي المقارن بالقانون، وتوصلتُ إلى أنَّ الرَّضَاع الطبيعي حقٌ أصيلٌ للطِّفل، ووجوب الرَّضَاع على الأمِّ، ولا تستحق الأمُّ على الرَّضَاع أجرًا، وأُجرة الرَّضَاع في حال وجوبه يكون على الأَب، ومُدَّة الرَّضَاع سنتين اختيارًا، فإن رأى الوالدين فطم الطِّفْل قبل ذلك، فيجوز، ما لم يَضُرُّ بصحةِ الطِّفْل. Abstract: Children are the adornment of the life of this world, and the builders of a beautiful tomorrow, so care should be taken of them and their rights, including their right to breast-feeding, and for this reason this study came, and the research problem lies in the statement of the child’s right to breast-feeding, in Islamic jurisprudence and law, and the goal is to clarify the provisions of breast-feeding the child in Islamic jurisprudence , and in the law. Following the comparative jurisprudential approach to the law, I concluded that breastfeeding is an inherent right for the child, and the obligation to breastfeed is on the mother, and the mother does not deserve a wage for breastfeeding, and the breast-feeding wage is on the father, and the period of breastfeeding is two years by choice. with the health of the child.
