الدسترة الخاصة بالصفقات العمومية في ظل المرسوم الرئاسي 15/247 المؤرخ في 16/09/2015

الملخص
لتلبية الحاجات العامة وحماية المال لعام، تلجأ الإدارة إلى التعاقد من خلال الصفقات العمومية، باختيار متعامل متعاقد تتوفر فيه جميع الشروط التي نص عليها القانون المنظم للصفقات العمومية، لكن في المقابل على الإدارة المتعاقدة أن تحترم المبادئ التي يقوم عيها الطلب لعمومي وهي النزاهة، الشفافية وحرية الدخول إلى الطلب العمومي، هذه الأخيرة المجسدة في سلسلة من الشروط والضوابط القانونية منظمة في إطار قانوني وهو دفتر الشروط، الذي يعتبر احترامه بمثابة جواز تأشيرة الدخول إلى الطلب العمومي من خلال احتوائه على أهم الإجراءات القانونية المجسدة لمبادئ الطلب العمومي، لحد الآن الموضوع يبدو عاديا لكن الإشكال الذي وقع هو صدور المرسوم تنفيذي رقم 21-219 المؤرخ في 20 ماي 2021، المتضمن دفتر البنود الإدارية العامة المتعلق بالأشغال، وعدم صدور البنود الإدارية المتعلقة بباقي أنواع الصفقات العمومية وكذا عدم صدور دفاتر التعليمات المشتركة للصفقات العمومية بمختلف أنواعها. الكلمات المفتاحية: ، ، ، ، Abstract: To meet the public needs and protect the money for a year, the administration resorts to contracting through public deals, by choosing a contracting dealer who fulfills all the conditions stipulated in the law regulating public deals, but in return the contracting administration must respect the principles upon which the public request is based, which is integrity, Transparency and freedom of entry to the public application, the latter embodied in a series of legal conditions and controls organized in a legal framework, which is the book of conditions, the respect of which is considered an entry visa to the public application by containing the most important legal procedures embodying the principles of the public application for, So far, the matter seems normal, but the problem that occurred is the issuance of Executive Decree No. 21-219 of May 20, 2021it includes the general administrative items book related to works, and the non-issuance of administrative items related to the rest of the types of public deals, as well as the non-issue of joint instruction books for public deals of all kinds.
