الاختصاص بابرام الصفقات العمومية على ضوء المرسوم الرئاسي 15/247 المتعلق بالصفقات العمومية وتفويضات المرفق العام

الملخص
تعتبر مرحلة ابرام الصفقة العمومية المرحلة الاساسية في هذا النوع من العقود ،ولذلك احاطها المشرع بجموعة من الشروط والضمانات القانونية التي من اهمها تحديد الجهات الادارية المختصة بإبرام العقد سواء على صعيد الادارات المركزية او على صعيد الادارات المحلية ، حيث تولى المشرع توزيع هذا الاختصاص بين الادارات فيما بينها وايضا داخل الشخص المعنوي العام المعني بإبرام الصفقة العمومية من جهة ثانية . وقد اورد المشرع ضمن المرسوم الرئاسي 15/247 المتعلق بالصفقات العمومية وتفويضات المرفق العام بعض القيود على عنصر الاختصاص تتمثل بصورة اساسية في ضرورة الحصول على تأشيرة لجنة الصفقات العمومية . Résumé L’étape de la conclusion du marché public est l’étape principale de ce type de contrat, et le législateur l’a donc entouré d’un ensemble de conditions et de garanties juridiques, dont la plus importante est l’identification des autorités administratives compétentes pour conclure le contrat, que ce soit au niveau des administrations centrales ou au niveau des administrations locales, où le législateur a repris la répartition de cette compétence entre les administrations entre elles et également au sein de la personne morale publique concernée par la conclusion du marché public d’autre part. Le législateur a inclus dans le décret présidentiel 15/247 sur les marchés publics et les délégations du service public certaines restrictions sur l’élément de compétence, principalement la nécessité d’obtenir un visa de la Commission des marchés publics. Abstract The stage of concluding the public contract is the main stage of this type of contract, and the legislator has therefore surrounded it with a set of legal conditions and guarantees, the most important of which is the identification of the administrative authorities competent to conclude the contract, whether at central or local government level, where the legislature has taken over the distribution of that competence between the administrations among themselves and also within the public legal person concerned by the conclusion of the public contract on the other hand. The legislator included in Presidential Decree 15/247 on Public contrats and Public Service Delegations certain restrictions on the element of competence, mainly the need to obtain a visa from the Public Procurement Commission.
