الملخص
ملخص: تعد ظاهرة البناء غير المشروع و عدم البناء بالمواصفات القانونية اللازمة اي بعبارة اخرى البنايات غير المشروعة ظاهرة ذات بعد سياسي و اجتماعي و اقتصادي قديمة ، وقد كان لها الثر السئ على كل المستويات نظرا لتعلقها بالنظام العام بكل جوانبه ، لهذا سعت السلطات المعنية لمحاولة احتواء و تسوية هذه الظاهرة بكل جوانبها في حقب متباينة منذ الاستقلال إلى يومنا هذا عبر اطر قانونية مختلفة ، وبتسخير الوسائل المادية و البشرية المختلفة ، لكن مع ذلك تبقى هذه الظاهرة متفشية ولم تجد الحلول القانونية طريقا للقضاء عليها وذلك راجع إلى أسباب و عوامل كثيرة ، قانونية إدارية و سياسية ، لكن مع كل هذا فان العمل نحو تحقيق المشروعية بتطبيق القاعدة القانونية حلم قد يتحقق بتضافر جهود مختلف الفاعلين. Abstract:The phenomenon of illegal construction and failure to build with the necessary legal specifications, in other words, illegal construction is an ancient phenomenon with a political, social and economic dimension, and it has had a bad impact at all levels due to its attachment to public order in all its aspects. Therefore, the concerned authorities have sought to try to contain this phenomenon. In all its aspects, in different eras from independence to the present day, through different legal frameworks, and by harnessing various material and human means, but despite this, this remains widespread, and legal solutions have not found a way to eliminate it, and this is due to many reasons and factors, legal, administrative and political, but with All this means that working towards achieving legitimacy by applying the legal rule is a dream that may be achieved through the combined efforts of various actors.
