القواعد الفقهية الخمس الكبرى عند الإمام البخاري من خلال تراجم الأبواب تقعيدا وتفريعا

الملخص
تناولت في هذه الدراسة موضوع القواعد الفقهية الخمس الكبرى عند الإمام البخاري وتطبيقاتها من خلال تراجم أبواب الجامع الصحيح تقعيدا وتفريعا، أستهل ببعض كلام الأئمة عن القاعدة تمهيدا، ثم أذكر تبويبه بالقاعدة في تراجم الأبواب، ومستندها من السنة النبوية عنده، ثم أعقبها بالجانب التطبيقي تمثيلا لها من خلال تبويبات الإمام مع الإيجاز، وهدفي إبراز التقعيد الفقهي عند الإمام، إذ لم يخصص بالدراسة من قبل-والله أعلم، فهي جديرة أن توسع، إذ تبين لي من خلال البحث فقه الإمام البخاري وحسن تفريعه واستدلاله وتبويه على القواعد الخمس، وإن لم يسمها بما اصطلح عليه الفقهاء بعده، وأنّه ذكر كل مستنداتها من السنة النبوية إلاّ قاعدة الضرر يزال، لأنّ مستندها حديث على غير شرطه، والله أعلم. In this study I dealt with the topic of the five major jurisprudence rules of Imam al-Bukhari and their applications through translations of the chapters of al-Jami al-Sahih, I begin with some words of the imams about al-Qaeda as a prelude,Then I mention its tabulation in Al-Qaeda in Translations of the chapters, and based on the Sunnah of the Prophet with him, Then it was followed by the practical side as a representation of it through the Imam tabs with brief, And my aim is to highlight the doctrinal constraint of the Imam, Since it was not assigned to study before and God knows best - especially the major rules, It is worth expanding, As it became clear to me through research the jurisprudence of Imam Al-Bukhari, his good branching, his reasoning, and his recognition of the five rules, If he did not call it what the jurists termed after him, And that he mentioned all its documents from the Sunnah of the Prophet except the rule of harm is removed, Because her document is a hadith mursal, God knows.
