إشكالية إسناد المسؤولية الجنائية الدولية عن أفعال كيانات الذكاء الإصطناعي

الملخص
صاحب التطور العلمي ظهور ما يعرف في يومنا هذا بالذكاء الاصطناعي الذي غير وقلب موازين القوى بشكل أكثر وضوح من السابق, نظرا لما حققه من اكتساح لشتى المجالات فلم يعد يقتصر استعماله على المجال الطبي، بل توغل في مجالات أخرى وبالأخص في المجال العسكرية، حيث تناولنا بالدراسة في هذه الورقة البحثية أحد أهم تطبيقات الذكاء الاصطناعي، آلا وهو الروبوت الذكي الذي تزايد استعماله في العماليات القتالية، باعتباره كيان متميز بنوع من الاستقلالية في اتخاذ بعض القرارات أثناء سير العمليات القتال، وهذا حسب الظروف المحيطة به دون تدخل الإنسان، مما استلزم منا تحديد طبيعته القانونية ثم تحديد الجهات المسئولة عن أفعاله المجرمة دوليا. The scientific development was accompanied by the emergence of what is known today as artificial intelligence, which changed and upset the balance of power more clearly than before, Due to the sweep of various fields, its use is no longer limited to the medical field, but has penetrated into other fields, especially in the military field, where we have studied in this research paper one of the most important applications of artificial intelligence, namely, the intelligent robot, which is increasingly being used in combat operations, as a distinct entity with a kind of independence in making some decisions during the conduct of combat operations according to the circumstances surrounding it without human intervention, which necessitated us to determine its legal nature and then identify those responsible for its internationally criminal acts.
