الخدمة الشاملة و تأثيرها على مقاربة المرفق العام في الجزائر

الملخص
ظهر مصطلح الخدمة الشاملة في الجزائر بموجب القانون 18/04 المتعلق بالقواعد العامة للبريد والمواصلات السلكية واللاسلكية، نتيجة تطبيق قانون المنافسة على النظام القانوني للمرفق العام، وتحقيقا للتوازن بين مصالح المستهلكين من جهة والمتعاملين الاقتصاديين من جهة أخرى في المرافق العامة الشبكية. وبناءا عليه، تطور مفهوم الخدمة الشاملة في الجزائر في ظل الانفتاح الاقتصادي وخصخصة المرافق العامة الشبكية نظرا لتطور أركانه التي تفاعلت وتأقلمت مع هذه الظروف الاقتصادية والاجتماعية في الدولة. Abstract: The term universal service was introduced in Algeria by Act n° 03-2000, on the post and telecommunication common rules, as a result of the competition-law application on the public-facility legal system, and aiming at balancing the interests of consumers and the economic operators in the network public facilities. Based on the above, the concept of universal service has evolved in Algeria in light of economic openness and the privatization of network public facilities, due to the interaction between its components with these new economic and social circumstances; this is in the aim of providing citizens’ basic services in the country of high quality and at reasonable prices respecting the principles of equality, universality and adaptability.
