طبيعة النصوص القانونية المنظمة لضبط نشاط الإعلام في القانون الجزائري

الملخص
ملخص: يعتبر الحق في الإعلام وسيلة لتعريف الشخص أو الجمهور بصفة عامة بشتى المعلومات والأخبار التي يرغب في معرفتها في سبيل تنوير الأذهان وفهم المسائل على حقيقتها والتي يتولى تقديمها محترفين في الميدان يطلق عليهم الصحافيين بمختلف أسلاكهم. من هذا المنطلق فقد عمدت مختلف التشريعات ومن بينها المشرع الجزائري على إصدار نصوص قانونية تحدد كيفية ممارسة الإعلام كنشاط من خلال تكريس مبدأ هام وهو الحرية في الإعلام في مقابل احترام مجموعة من الأحكام لا يجب مخالفتها وبالخصوص إخضاع الممارسين لنشاط الإعلام إلى عملية الضبط كمفهوم معروف في النشاطات الأخرى على غرار النشاط الاجتماعي والنشاط الإداري والنشاط الاقتصادي. بهذا المعنى تتمحور هذه الورقة البحثية حول موقف المشرع الجزائري من عملية ضبط نشاط الإعلام من حيث النظر في نوع النصوص القانونية الصادرة في هذا المجال. الكلمات المفتاحية: الحق في الإعلام، القانون الجزائري، الضبط، الصحافة المكتوبة، السمعي البصري. Abstract : The right to information is a means of making the person or the general public discover the various information and news that they wish to know in order to enlighten minds and understand the issues as they really are, which are presented by professionals in the field. From this point of view, various legislations, including the Algerian legislator, have enacted legal texts which define the methods of exercise of the media as an activity by enshrining an important principle, which is the freedom of the media subject to the respect of a set of provisions that should not be violated, subjecting in particular the practitioners of media activity to the process of regulation as a well-known concept in the activities. Other activities are similar to social activity, administrative activity and economic activity. In this sense, this article revolves around the position of the Algerian legislator on the process of regulation of media activity in terms of examining the type of legal texts issued in this area.
