الملخص
يجسّد دفتر الشّروط أحد مظاهر امتياز السّلطة العامّة في عقود الصّفقات العمومية، والتي تبادر إلى وضع البنود التّعاقدية بطريقة انفرادية قبل أي دعوة للمنافسة، بالّنظر إلى مركزها المتميز، والذي يُمكِّنها من ممارسة جملة من الامتيازات والسّلطات في مواجهة المتعاقد، وهو الأمرُ الذي لا يستقيم في عقود القانون الخاصّ. ونستهدف من خلال هذه الورقة البحثية إلى تسليط الضوء على الرّقابة الإدارية التي استحدثها النّاظم لمراقبة مشاريع دفاتر الشّروط كمرحلة تمهيدية متقدّمة في الحياة القانونية لإبرام وتنفيذ عقود الصّفقات العمومية، بغية تحقيق نجاعة الطّلب العمومي وحماية المال العامّ في ظلّ حريّة الوصول إلى الطلبات العمومية، وشفافية الإجراءات، والمساواة بين المترشّحين، من جهة، وضمان حقوق المتعهد أو المترشّح من جهة مقابلة. The conditions book embodies one of the manifestations of public authority’s privilege in the contracts of public deals, which initiates the status of contractual items in a solitary manner before any invitation to compete, by looking at its distinguished position, which enables it to practice some privileges and authorities in the face of the contractor, which is not evaluated in contracts private law. Through this research paper, we aim to shed light on the administrative supervision that regulations have developed to monitor the projects of the provisions of conditions as an advanced preliminary stage in the legal life to conclude and implement public transactions contracts, in order to achieve the efficacy of public demand and protect public money in light of the freedom to reach public requests, and the transparency of procedures, Equality between the candidates, on the one hand, and guarantee the rights of the contractor or the candidate on the one hand.
