الملخص
الملخص لقد أصبح دور المحامي في تعزيز الحقوق والحريات الأساسية للمتقاضين حلقة مهمة وضرورية من أجل ضمان مبدأ المحاكمة العادلة ونصرة الحق وتجسيد سيادة القانون ، ويظهر ذلك من خلال مباشرة وتحريك آلية الدفع بعدم الدستورية ، كما تبرز هذه الأهمية في عدة نواحي السياسية منها والقضائية ، فمن الناحية السياسية يعد دور المحامي فاعلا أساسيا في تكريس الرقابة وتعزيز الشفافية ، أما من الناحية القضائية فإن دوره يبرز أساس من خلال موقعه ضمن مكونات السلطة القضائية العنصر الفعال في تحقيق ما كرسه المشرع من مبادئ عالميا في الدستور والقانون ضمانا للحقوق والحريات الدستورية للأفراد . Summary: The role of the lawyer in promoting the basic rights and freedoms of litigants has become an important and necessary link in order to ensure the principle of a fair trial, championing the right and embodying the rule of law. The role of the lawyer is considered an essential actor in consolidating oversight and enhancing transparency. As for the judicial aspect, his role is highlighted mainly through his position within the components of the judicial authority, the effective element in achieving the universal principles enshrined by the legislator in the constitution and the law to guarantee the constitutional rights and freedoms of individuals.
