الملخص
تتحكم ضوابط فقهية قانونية في تنظيم العلاقات ضمن النسيج العمراني للمدن المنتمية إلى العالم الإسلامي، بحيث تتسع سلطة الدولة بمختلف أجهزتها الإدارية ضمن المركز أين تتواجد الأسواق العامة كما تتسع معها حرية استغلال المجال الاقتصادي للأفراد، في حين تتقلص وتتناقص هذه السلطة والحرية الاقتصادية معا كلما توغلنا إلى أطراف المدن أين تتواجد الأحياء السكنية والأزقة والدور، على هذا الأساس اخترت نص الفرسطائي للبحث في بنية المدينة-الواحة ومعرفة خصوصياتها الحضرية ومختلف الأحكام والقوانين الفقهية التي تنظم توزيع الأنشطة الاقتصادية بها من: أسواق مركزية أو سويقات وحوانيت، وإمكانات ممارسة الحرف داخلها أو خارجها It is well known that jurisprudential legal regulations control the organization of relations within the urban fabric of cities belonging to the Islamic world. The authority of the state with its various administrative organs expands within the center where the public markets are located. The freedom of individuals to exploit the economic field expands too.However, both the authority and the economic freedom shrinks and decreases as we go deeper into the outskirts of the cities, where the residential neighborhoods, alleys, and floors are located. Based on this, I chose the text of Al-Foresta’ï to investigate the structure of the city- oasis and explore its urban specifics and the various jurisprudential regulations that control the distribution of economic activities: central markets or mini-markets and shops, and the possibilities of craft practicing inside or outside.
