الملخص
الملخص: يعدّ علم الفقه أهمّ العلوم التي أنتجها العقل الإسلامي، من خلال تفاعلاته من النّص الشّرعي، مشكّلا أهمّ الملامح العلميّة للحضارة الإسلامية عبر التاريخ، وهو أحد روافد المؤسسة للعقلية الإسلاميّة، وقد شهد الغرب الإسلامي عموما والمغرب الأوسط -الجزائر- خصوصا حركيّة فقهية كبيرة في القرون الثلاث المعنية بالبحث من خلال موسوعة تاريخ الجزائر الثقافي للمؤرخ أبي القاسم سعد الله، والّتي لا تزال محل اهتمام الباحثين الذين يعتبرون التنقيب في معالمها والوقوف على مادتها التاريخية بالبحث والدّراسة مهمّة علميّة كبيرة لمواصلة بناء الدّرس التاريخي والثقافي للمغرب الأوسط. يطلعنا هذا البحث على أهمّ الفقهاء الذين أثروا الحياة الفقهيّة في الجزائر، والوقوف على مؤلفاتهم التي كان عليها محور الدّرس الفقهي في تلك الفترة سواء المذهب المالكي الذي يعتبر أكثر المذاهب توسّعا وانتشارا وإثراء للمكتبة الجزائرية والعربيّة الإسلاميّة بالمؤلفات، وكذلك المذاهب الأخرى المنافسة له كالمذهب الحنفي والمذهب الإباضي، كما يعتبر الفقه الإسلامي مادة تاريخية دسمة لمعرفة الكثير من الجوانب المعرفيّة، الاجتماعية، السّياسيّة، والاقتصاديّة. Abstract: The Islamic Jurisprudence is the most important science produced by the Islamic mind, through its interactions with the religious text, forming the most important scientific features of the Islamic Civilization throughout history, and it is one of the foundational tributaries of the Islamic mentality. The subject of the study, through the Encyclopedia of the Cultural History of Algeria by the historian Abi Al-Qasim Saad Allah, which is still of good interest to researchers who consider researching its details and standing on its historical data through research and study is a major scientific task to continue building the historical and cultural lesson of the Middle Maghreb. This research informs us about the most important jurists who influenced the Islamic Jurisprudential life in Algeria, and shows us their books which were the focus of the jurisprudential study in that period, whether the Maliki school, which is considered the most widespread and enriching source for the Algerian and Arab-Islamic libraries, as well as other schools competing with it such as the Hanafi school and the Ibadhi. TheIslamic jurisprudence is also considered a rich historical data to know many aspects In the field ofknowledge, politics, society, and economics.
