الملخص
الملخص إن عملية النقد كما هو واضح من تطبيقاتها في الفقه المالكي: سايرت هذا الفقه في جميع مراحله، إذ ظهر في كل مرحلة منها فقهاء نقاد، انصبت جهودهم على مراجعة ما أنتجه الفقهاء السابقون من فقه، ببيان قويه من ضعيفه، وما يصلح العمل به منه وما لا يصلح، وقد قصدت من هذه الدراسة أن أوضح الخطوط العامة للمنهج النقدي الذي سلكه الفقهاء المالكية في نقد المصنفات الفقهية في المذهب المالكي مرحلة تأسيس المذهب . Abstract The process of criticism, as is clear from its applications in the Maliki at each jurisprudence, went along with this jurisprudence in all its stages, stage critical jurists appeared, their efforts focused on reviewing what the previous jurists produced of jurisprudence, with a strong statement from the weak, and what works and what is not. The purpose of this study is to clarify the general outlines of the critical approach to the jurisprudential literature in the Maliki school of thought since the establishment stage of the school.
