الجريمة المنظمة العابرة للحدود (جريمة الاتجار بالنساء في القانون الدولي أُنموذجًا)

الملخص
منذ وضع الاتجار بالنساء على جدول الأعمال الدولي كمشكلة عالمية في مطلع التسعينيات كانت ردود فعل الحكومات والمنظمات الدولية الحكومية غير كافية وركزت بشكل رئيسي على مكافحة الجريمة المنظمة من دون إيلاء اهتمام كاف بدعم الحاجات المحددة للنساء اللواتي يتم الاتجار بهـن وإعداد استراتيجيات لمنع انتهاكات حقوق الإنسان التي ترتكب ضدهن والتحقيق في هذه الانتهاكات ومعاقبة مرتكبيها وإيجاد العلاج الدائم لها، إضافةً إلى دراسة أهم أسباب الاتجار بالنساء وآثارها السلبية على المستوى الوطني والدولي وفعالية الإجراءات الوقائية في هذا الصدد، وطرق مكافحة الاتجار بالمرأة للحد من انتشارها. وحسب منظمة العمل الدولية فإنه يقصد بجريمة الاتجار بالنساء: "كل عمل أو خدمة تُفرض على شخص تحت التهديد أي عقاب، والتي لا يكون فيها الفرد قد قدم نفسه لها طوعًا من صُور العُبُودية التي تُمثل اتجارًا". Abstract: Since the introduction of trafficking in women on the international agend as a global problem in the early 1990s, the responses of governments and intergovernmental organizations have been inadequate and focused mainly on combating organized crime without paying sufficient attention to supporting the specific needs of trafficked women and developing strategies to prevent human rights violations being committed. Against them, investigate these violations, punish the perpetrators and find a permanent remedy for them. permanent remedy for them, In addition to studying the most important causes of trafficking in women and its negative effects at the national and international levels, the effectiveness of preventive measures in this regard, and ways to combat trafficking in women to limit its spread. According to the International Labor Organization, the crime of trafficking in women means: "Every work or service that is imposed on a person under the threat of any punishment, and for which the individual has not offered himself voluntarily as a form of servitude that constitutes trafficking."
