نطاق عملية المسح العقاري في القانون الجزائري من حيث الموضوع والأهداف

الملخص
يشكل العقار ثروة اقتصادية لا تزول ومورد جبائي للخزينة العامة، لذلك تعين على الدولة اعداد بنك معلومات عقارية تشرف عليه جهات رسمية، بموجبه يمكن ضبط مختلف الملكيات العقارية من خلال تحديد قوامها ومواقعها والحقوق العينية الواقعة عليها ومعرفة أصحابها، ويتم بلوغ هذا الهدف بإجراء عملية فنية إحصائية بطريقة قانونية، يطلق عليها عملية المسح العقاري، والتي نظمها المشرع بموجب مقتضيات الأمر رقم 75/74المتضمن اعداد مسح الأراضي العام وتأسيس السجل العقاري. من خلال هذه الورقة البحثية تم التطرق من ناحية إلى موضوع عملية المسح العقاري، حيث تبين بأن جميع أصناف الملكية العقارية معنية بهذه العملية، كما تم التطرق من ناحية أخرى إلى مسألة الأهداف التي ترمي إليها عملية المسح العقاري، وقد تبين أن لهذه الأخيرة أهدافا متعددة الجوانب، تتعلق أساسا بالجانب القانوني حيث تظهر أهميتها في تنظيم الوعاء العقاري وضبط الملكية العقارية، وكذلك أهميتها من الناحية الإقتصادية والجبائية مما يساهم في تحقيق الإئتمان العقاري وتطوير السوق العقارية. الكلمات المفتاحية: المسح العقاري، موضوع المسح العقاري، أهداف المسح العقاري، حماية المالك، تنظيم الوعاء العقاري. Abstract: Real estate constitutes an inexhaustible economic wealth and a fiscal resource for the public treasury. Therefore, the state had to create a real estate data bank supervised by the official authorities, according to which the various real estate properties can be controlled by determining their strength, location, rights in kind over them and knowing their owners. This objective is achieved by conducting a statistical technical process in a legal way, called the cadastral process, which was organized by the legislator in accordance with the provisions of order nᵒ75/74 which includes the preparation of the general cadastre and the establishment of the land register. through this research paper, on the one hand, the purpose of the cadastral process was addressed, as it was found that all types of real estate property are concerned by this process, and on the other hand, the question of objectives that the cadastral process aims at, where it was found that the latter has multiple objectives, mainly related to the legal aspect, as it shows its Importance in the regulation of the land base and the control of real estate property, as well as its economic and fiscal Importance that contributes to the realization of real estate credit and the development of the property market.
