الملخص
الهدف من خلال هذا البحث هو التعرف على المرجعية الفقهية للمشرع الجزائري في أحكام التبرعات باعتبار قواعدها القانونية مستمدة من الشريعة الإسلامية، وذلك بالبحث في مدى ثبات المشرع على مرجعية فقهية محددة وموقع المذهب المالكي منها. وقد توصلنا من خلال البحث إلى عدم ثبات المشرع على مرجعية محددة لا من حيث المصدر المادي ولا من حيث المرجع عند عدم وجود نص قانوني، وهو وضع ينبغي تداركه. The aim of this research is to detect the doctrinal reference of the Algerian legislator in the provisions of donations given that its legal rules has been obtained from Islamic law(Sharia), that by searching for the stability of the legislator on specific reference and the the position of the Maliki doctrine from this reference. Through research we find that the legislator is not stable on a specific reference, whether related to of the material source or whether related to the reference in the absence of a legal text, then we must be corrected this situation
