حماية أماكن العبادة في ظل أحكام الشريعة الإسلامية والقانون الدولي الإنساني Protection Of Places Of Worship Under The Provisions Of Islamic Sharia And International Humanitarian Law

الملخص
تعد حرية العقيدة من أهم وأول الحريات التي اعترف بها في العصور الحديثة، بعد أن كانت دائما محلا لاعتداءات صارخة أكثر من الاعتداءات التي تقع على بقية الحريات الأخرى، وقد أقرت الأديان والقوانين الوضعية في أكثر من موضع حق الإنسان في حرية ممارسة الشعائر الدينية زمن النزاعات المسلحة من خلال النص على ضمانه من جهة، ومن جهة أخرى النص على حماية أماكن العبادة كضمانة لممارسة هذا الحق، وبالتالي تحظى أماكن العبادة بأهمية بالغة لارتباطها بعقيدة الفرد، لذا سعت كل من قواعد الشريعة الإسلامية وكذا قواعد القانون الدولي الإنساني لتوفير حماية لهذه الأماكن لاسيما زمن النزاعات المسلحة، وعلى الرغم من ذلك مازالت هذه الأخيرة تشهد العديد من الانتهاكات والاعتداءات الصارخة على مرأى ومسمع المجتمع الدولي بأكمله. Freedom of belief is one of the most important and first freedoms that were recognized in modern times, after it was always the subject of more blatant attacks than attacks on other freedoms. Religions and positive laws have recognized in more than one place the human right to freedom of practicing religious rituals in times of armed conflicts. By stipulating its guarantee, on the one hand, and on the other hand, the provision to protect places of worship as a guarantee for the exercise of this right, and therefore places of worship are extremely important for their connection to the individual's belief, so both the rules of Islamic law and the rules of international humanitarian law sought to provide protection for these places, especially in times of conflict. In spite of this, the latter is still witnessing many flagrant violations and attacks in full view of the entire international community.
