قراءة قانونيّة في ضوابط تقسيم الأراضي الفلاحيّة الخاصّة

الملخص
تستهدف هذه الورقة البحثيّة إبراز دور النّصوص التّشريعيّة والتّنظيميّة في حماية الأراضي الفلاحيّة الخاصّة وواجب المحافظة القصوى على وجهتها من الزّحف العمرانيّ العشوائيّ، والوقوف على مدى تحكّم هذه النّصوص تحديدا في منع تفتيتها إلى مساحات ضئيلة تؤثّر على قابليّتها للاستغلال الأمثل وتقلّل من أهمّيّتها الاقتصاديّة وتقوّض وظيفتها الاجتماعيّة، وذلك من خلال ضبط المساحات الدّنيا لتقسيمها بموجب أحكام خاصّة تتماشى مع مقاييس التّوجيه العقاريّ وبرامجه ومخطّطات التّوجيه الفلاحيّ، خلافا للقواعد العامّة في التّهيئة والتّعمير. غير أنّ الأراضي الفلاحيّة الخاصّة لا تزال تشكّل مجالا خصبا للاستخدام العمرانيّ الفوضويّ بتجزئتها وتوجيهها لأغراض البناء، رغم ضبط إطار مرجعيّ لعمليّة تقسيمها مع الحفاظ على طابعها الفلاحيّ؛ والحقيقة أنّ تحقيق الغاية التّشريعيّة من كبح انحسار مجالها واستنزاف مصادرها المائيّة لحساب الطّفرة العمرانيّة الّتي تشهدها الحياة الحضريّة بشكل متزايد، لم يكتمل بعد؛ نظرا لافتقار النّصّ التّنظيميّ الخاصّ بعمليّة تقسيم هذه الأراضي للإجراءات وعدم تعزيز هذه العمليّة بالنّصّ التّشريعيّ الخاصّ بعمليّة تجميعها، فضلا عن غياب مخطّطات التّوجيه الفلاحيّ. This research paper aims to highlight the role of legislative and regulatory texts in the protection of private agricultural land, and the duty of the utmost preservation of its destination from chaotic urbanization, and the extent to which these texts are controlled specifically to avoid their fragmentation into small areas which affect their ability to be exploited in an optimal way, and it reduces its economic importance and undermines its social function, by fixing minimum surfaces to be divided according to particular provisions in accordance with the standards of the land directive, its programs and the plans of the agricultural directive, contrary to the general rules of planning and urbanization. However, private agricultural land still provides fertile ground for chaotic urban use by parcelling it out and orienting it towards construction, although it sets a frame of reference for the process of division while preserving its agricultural character. Indeed, the achievement of the legislative objective of curbing the scarcity of its space and the depletion of its water resources to take into account the urban development that urban life is increasingly experiencing, is not yet completed. Due to the absence of procedures in the regulatory text for the process of sharing these lands and the lack of accompaniment of this process with the legislative text for the process of their collection, in addition to the absence of agricultural orientation plans.
