ضوابط ممارسة الأنشطة الفلاحيّة كآليّة قانونيّة لحماية المياه والأوساط المائيّة

الملخص
يقصد بـ "الأنشطة الفلاحيّة" سير دورة نموّ منتوج نباتيّ أو حيوانيّ وتكاثره، وكلّ نشاط يستند إلى الاستغلال أو هو امتداد له، ولا شكّ أنّ الممارسة المثلى للأنشطة الفلاحيّة المرتبطة بالتّربة مرهون بتزويدها بإمدادات الماء الفلاحيّ بنسب هائلة، منتظمة ومستمرّة، وأنّ كفاءة استخدام الماء وعدم إنهاكه وتحسين كفاءة إنتاج الغذاء، هي ضمانات لتحقيق وتعزيز الأمن المائيّ والأمن الغذائيّ. استهدفت هذه المساهمة استجلاء دور المشرّع في إرساء أسس الموازنة بين تحدّيّات الأمن المائيّ ومقتضيات تحقيق الأمن الغذائيّ من خلال وضعه ضوابط لممارسة الأنشطة الفلاحيّة حمايةً للمياه والأوساط المائيّة، وقد خلصت الدّراسة إلى لمس جهود مضنية سايرت بها الجزائر الاهتمام العالميّ بالمياه، غير أنّ نتائج تلك الجهود تبعث على اطمئنان حذر؛ نتيجة لعوامل متداخلة تحدّ منها. «Agricultural activities» mean the course of the growth and reproduction cycle of a plant or animal product, and any activity is based on or is an extension of the holding. Undoubtedly, the best practice of agricultural activities related to soil depends on its provision with agricultural water supplies in enormous, regular and continuous proportions, and that the efficiency of water use and the lack of l 'depleting and improving the efficiency of food production are guarantees to achieve water and food security. This contribution aimed to clarify the role of the legislator in laying the foundations for a balance between the issues of water security and the requirements of achieving food security by setting controls for the practice of agricultural activities in order to protect water. and aquatic environments by reassuring yourself cautiously; Due to intertwined factors that limit it.
