Le Rôle De La Victime Dans La Genèse Du Crime : Entre Provocation Et Consentement

Résumé
Résumé La victime est considérée comme un mot qui colporte l’idée d’une passivité dans un rapport infracteur-victime, elle est le sujet d’une science contemporaine qui est la victimologie empirique. Cette science s’est focalisée sur le rôle de la victime dans la genèse du crime, auparavant considérée comme un « survivant » d’un acte prohibé par la loi, sans qu’elle soit un agent incitateur direct ou indirect de sa victimation. En temps actuel cette dimension d’inertie dans la commission d’infraction est peu reconnue, car la victime en dépit de son statut d’une personne qui subit un préjudice, elle peut être la source créatrice de l’infraction, mais comment peut-elle être la source de sa victimation ?, Telle est la problématique posée dans cet article. Elle peut l’être soit par attitude dynamique qui se manifeste par la provocation, ou bien encore par attitude passive traduite par la victime qui consent à son agression ملخص تُعتبر الضحية كلمة تروج لفكرة السلبية في علاقة الجاني والضحية، فهي موضوع علم معاصر وهو علم الضحية التجريبي. وقد ركز هذا العلم على دور الضحية في خلقالجريمة، حيث كانت تُعتبر سابقًا "ناجية" من فعل محظور بموجب القانون، دون أن يكون للضحية عامل تحريض مباشر أو غير مباشر لإرتكاب جريمة في حقها. في الوقت الحاضر، هذا البعد من قصور الضحية في ارتكاب الجريمة لا يُعترف به كثيرًا،وهذا على الرغم من وضعها كشخص ألحق به ضرر،فيمكن أن تكون مصدر خلق الجريمة، ولكن كيف للضحية أن تكون مصدرًا لاعتداء يلحقها؟هذه هي الإشكالية المطروحة في هذا المقال. يمكن أن تكون إما من خلال سلوك إيجابي الذييعكسه الاستفزاز، أو من خلالموقف سلبي مترجم من خلال رضى المجني عليه وقبول فعل الإعتداء Abstract The victimisconsidered as a wordthatpeddles the idea of passivity in an offender-victimrelationship, itis the subject of a contemporary science whichisempiricalvictimology. This science has focused on the role of the victim in the genesis of the crime, previouslyconsidered as a “survivor” of an actprohibited by law, withoutbeing a direct or indirect inciting agent of hisvictimization. Atpresent, this dimension of inertia in the commission of an offense islittlerecognized, because the victim, despitehis/herstatus as a personwhosuffersharm, canbe the creative source of the offense, but how canhe/shebe the source of hisvictimization?, suchis the problemposed in this article. It canbeeither by dynamic attitude whichismanifested by provocation, or even by passive attitude translated by the victimwhoconsents to his/heraggression
