الإجراءات التحضيرية لمحكمة الجنايات

الملخص
تنقسم هذه الإجراءات إلى إجراءات تحضيرية إلزامية لتمكين المتهم من محاكمة عادلة و المتمثلة أساسا في تبليغ قرار الإحالة و استجواب المتهم و تبليغه قائمتي المحلفين و الشهود و إرسال الملف الجنائي من طرف النائب العام إلى قلم كتابة محكمة الجنايات مع نقل المتهم إذا كان محبوسا إلى مقر انعقاد جلسة محكمة الجنايات . بالإضافة إلى الإجراءات الإلزامية هناك إجراءات تحضيرية غير إلزامية أو استثنائية يقررها رئيس محكمة الجنايات متى رأى ضرورة لها و المتمثلة في التحقيق التكميلي إذا تبين للرئيس أن التحقيق ناقص أو غير كاف أو ظهرت عناصر جديدة ، بالإضافة إلى ضم القضايا في حالة صدور أكثر من قرار إحالة من غرفة الاتهام ضد المتهمين في جناية واحدة ، و كذلك تأجيل الفصل في القضية إذا ثبت للرئيس أن القضية غير جاهزة للفصل فيها ، و هذه الإجراءات إلزامية لتمكين المتهم من محاكمة عادلة. I These procedures are divided into compulsory preparatory procedures to enable the accused to have a fair trial, mainly represented in notifying the referral decision, interrogating the accused, informing him of the lists of jurors and witnesses, and sending the criminal file by the Public Prosecutor to the registry of the Criminal Court, with the transfer of the accused, if he is imprisoned, to a meeting place. In addition to the mandatory procedures, there are non-compulsory or exceptional preparatory procedures decided by the President of the Criminal Court when he deems it necessary, which is the supplementary investigation if the President finds that the investigation is incomplete or insufficient or new elements appear, in addition to joining cases in the event that more than one referral decision is issued by The indictment chamber against those accused of a single felony, as well as adjourning the decision of the case if the president proves that the case is not ready to be decided, and these procedures are mandatory to enable the accused to have a fair trial.
