القانون الجزائي والأمن البيئي.

الملخص
تعتبر حماية البيئة كتراث مشترك للإنسانية ، ومواردها الطبيعية من النضوب والانقراض والتلوث، و ضرر الملوثات و الجرائم المرتكبة في حقها، نحو تحقيق الرفاه الاجتماعي ، هي ما يجسد حقيقة مفهوم الأمن البيئي ، غير أن تحقيق مفهوم هذا الأمن من الناحية العملية، مرهون بسن سياسات تشريعية تكفل للإنسان الحق الدستوري في بيئة سليمة ، وفي جميع الأحول لسنا في غنى عن آليات القانون الجزائي ، في ظل خطورة الجرائم البيئية المرتكبة ذات الوتيرة المتسارعة ، من خلال خصوصية التجريم البيئي، المتابعة الجزائية، و العقاب، في إطار تأمين تلبية احتياجات أجيال الحاضر ، مع الأخذ بعين الاعتبار نصيب الأجيال القادمة ، نحو إرساء تنمية مستدامة رشيدة ، وهو ما حاولنا التطرق إليه بنوع من الاختصار ، بأوجه نظر شخصية متواضعة ،ارتأيناها مفيدة لتعزيز آليات القانون الجزائي في سبيل تحقيق الأمن البيئي في إطار التنمية المستدامة . Protecting the environment as a common heritage of humanity, and its natural resources from depletion, extinction and pollution, besides pellutions damage and crimes committed against it , to wards social welfare, reflect the reality of environmental security concept however this concept is pratically linked to ligislative policies which protect the constitutional human rights to a sound environment. In all cases, the mechanisms of criminal law are necessary, given the seriousness of the environmental accelerative crimes, through the specificity of environmental criminalization, penal monitoring and punishment. To asurate the present generation needs and take in consideration the share of future generations, towards a sustainable development, which we tried to address the kind of shortcut, objects of a modest personal opinion , we saw it useful to strengthen the criminal law mechanisms in order to achieve environmental security in the context of sustainable development.
