حق الطفل في العمل بين الاجازة والمنع حماية له من المخاطر النفسية والاجتماعية

الملخص
باللغة العربية: على اعتبار أن الطفل ذلك الكائن المستضعف، بسبب عدم اكتمال نموه العقلي والنفسي والجسدي، فقد سعت جل التشريعات الدولية والوطنية بما فيها التشريع الجزائري الى حمايته في شتى المجالات، بالإضافة الى ضمان حقوقه وتكريسها له كفرد من أفراد المجتمع، ومن بين تلك الحقوق المعترف له بها: حقه في العمل مع وجود تحفظات على منحه هذا الحق بما لا يتعارض مع حمايته من المخاطر التي قد يتعرض لها في هذا المجال. ان هذه المخاطر التي قد تكون مخاطر جسدية تؤثر على نموه الجسدي، كما قد تكون مخاطر نفسية بسيكولوجية تؤثر على توازنه النفسي وعلى حياته الاجتماعية المستقبلية، لأجل ذلك وضع المشرع الجزائري ضوابط وقيود صارمة على تشغيل الأطفال حماية لهم تتعلق تارة بتحديد سن العمل ومجاله وأوقاته. باللغة الفرنسية: L’enfant cet être humain diminue de par son développement morale et physique et psychologique incomplet, ce qui a mené les législations internationaux et nationaux a le protégé de tous dangers et de lui accorde tous ses droits autant que membre important dans la société. Parmi ces droits, il est reconnu à l’enfant son droit au travail avec réserve de le protéger des dangers dans ce domaine, par la limite d’âge au travail et l’interdiction de pratiquer certains emplois, aussi lui assurer des mesures de sécurité contre tous danger morale ou physique ou socia باللغة الانجليزية: Considering that the child is that vulnerable being, due to his incomplete mental, psychological and physical development, most international and national legislation, including Algerian legislation, has sought to protect him in various fields, in addition to ensuring his rights and dedicating them to him as a member of society, and among those rights recognized to him : His right to work with reservations about granting him this right in a way that does not conflict with protecting him from the risks he may be exposed to in this field. These risks, which may be physical risks that affect his physical development, may also be psychological risks that affect his psychological balance and his future social life. For this reason, the Algerian legislator has established strict controls and restrictions on child labor to protect them, sometimes related to determining the age, scope and times of work.
