الحماية الجنائية للأطفال ذوي الإعاقة من جريمة التحرش الجنسي

الملخص
تهدف هذه الورقة البحثية إلى تناول الحماية الجنائية التي أقرها المشرع الجزائري للأطفال المعاقين، من أجل حمايتهم من جريمة خطيرة ألا وهي جريمة التحرش الجنسي، بإعتبارها من جرائم الاعتداءات الجنسية، التي انتشرت بشكل كبير في العقود الأخيرة، ويظهر خطرها خاصة عندما تمس فئة الأطفال بإعتبارها الفئة الضعيفة جدا في المجتمع، بسبب ما تتميز به من ضعف الإدراك والتمييز ويزيد الأمر صعوبة عندما يتعلق الأمر بالأطفال الذين يعانون من إعاقة، رغم هذا نلاحظ أن المشرع الجزائري وضع عقوبات بسيطة لا تتناسب مع الضرر الذي يسيب الضحايا، إضافة على عدم نصه على العقوبات التكميلية التي يمكن أن تطبق على الجاني من أجل توفير حماية إضافية للمجني عليه. This research paper aims to address the criminal protection approved by the Algerian legislator for children with disabilities, in order to protect them from a serious crime, which is the crime of sexual harassment, as one of the crimes of sexual assault, which has spread widely in recent decades, and its danger appears, especially when it affects the category of children as a category The very vulnerable in society, because of what is characterized by poor perception and discrimination, and the matter becomes more difficult when it comes to children with disabilities. Despite this, we note that the Algerian legislator set simple penalties that are not commensurate with the harm caused to the victims, in addition to not providing for complementary penalties that It can be applied to the offender in order to provide additional protection to the victim.
