الملخص

تهدف هذه الورقة البحثية إلى تناول الحماية الجنائية التي أقرها المشرع الجزائري لفئة الأطفال المعاقين، لحمايتهم من الاستغلال في أفعال التسول، على اعتبار أن مرحلة الطفولة تعد من المراحل الأكثر ضعفا التي يمر بها الإنسان في حياته، لما يفتقده خلالها من قدرة على التفكير، وإدراك حقيقة الأشياء التي تدور من حوله، وتزداد هذه المرحلة ضعفا، إذا كان الطفل يعاني من إعاقة، تعطل الأداء السليم لإحدى وظائفه التي يعتمد عليها في حياته اليومية، ولكن عوض أن يلقى الطفل المعاق الرعاية اللازمة لتدارك نقص إعاقته، وتحضيره ليكون ذا قابلية للاندماج الاجتماعي مستقبلا، فإن الواقع يظهر في العديد من المرات استغلاله في أفعال يجرمها القانون كالتسول، ليحقق المستغل بذلك عائدات مالية على حساب صحته ومستقبله، لذلك سيتم معالجة هذا الموضوع من خلال التعرض لحدود الحماية الجنائية التي أقرها المشرع لهذه الفئة الضعيفة من المجتمع. Abstract This paperaims to address the criminal protection approved by the Algerian legislator for the category of children with disabilities to protect them from exploitation in the acts of begging, considering that childhood is one of the most vulnerable stages experience by human in his life, where he is does not have the ability to think and understand the reality of things in This stage is further weakenedif the child has a disability, disrupts the proper functioning of one of his daily functions, but instead of receiving the child with the care necessary to remedy the probleme of disability, and prepare it to be socially viable in the future, appears in many times to exploit it at the acts criminalized under the law, such as begging, to achieve exploiter financial resources, at the expense of the disabled child and his future health, so will this topic be addressed through the limits of criminal protection stipulated by the Algerian legislature in favor of this addressvulnerable group in the society.
