ضوابط المسؤولية القانونية والرياضية لممارسي الرياضة

الملخص
الملخص: تعتبر الرياضة في العصر الحديث ذات أهمية، ومن أهم الميادين التي تناولتها بالدراسة الميدان القانوني وخاصة المنافسة الرياضية التي تشوبها بعض التصرفات والأفعال التي تنجم عنها مخاطر وأضرار للغير، يخضعها لـ «قواعد اللعبة"، و"القانون العام". خاصة ما تعلّق منها بقانون العقوبات الذي يجرم كل فعل يمس بسلامة الجسم، وتثبت في حقّ مرتكبيها المسؤولية، مع ما يترتّب عنه من تعويض وفق أحكام القانون المدني. يهدف البحث إلى محاولة التعرّف على قواعد الألعاب الرياضية، وفق التشريعات الوطنية، وخاصة ما يتعلّق منها بقواعد قانون العقوبات التي تجرّم كل فعل يمسّ بسلامة الجسم، وما يترتّب عنه من تعويض وذلك وفق أحكام القانون المدني. تعتمد هذه الدراسة على تحليل ودراسة النصوص القانونية المهمة ذات العلاقة بالبحث من خلال دراسة أهم العناصر التي تساهم في الوصول إلى المبتغى. الكلمات المفتاحية: القانون الرياضي؛ قواعد اللعب؛ المنافسات الرياضية؛ قانون العقوبات؛ التشريع الرياضي الجزائري. Abstract: Sport plays a very important role in our modern life and it is among the most important fields that have been studied in the legal field, since sports competitions can present certain behaviors and actions that generate dangers and damages that can affect others. From there, it is necessary that these behaviors and actions submit to the “rules of the game” and “public law”. This is why it is important to know the rules and legislation of sports games and the different national laws that have been designed in this regard. Above all, those which are centered on the rules of the penal code which prohibit and sanction each action which affects the bodily well-being of individuals, and all that it generates in compensation according to the civil code. The aim of this research is to try to identify the rules of practicing sports according to national legislation, especially those related to the provisions of penal code that criminalize any act that harms the integrity of the body, and the resulting compensation according to the provisions of civil code. This study relies on the analysis and study of important legal texts related to the research, by studying the most important elements that contribute to achieving the goal.
