الملخص
الملخص : نهدف في هذا المقال إلى البحث في الضمانات القانونية والحماية الصحية على متن السفن للعمال البحارة ونخص به المرأة البحارة ‘Women Maritimes ’ وفق عقود العمل البحرية و أهمها ضمان الأجور المستحقة للعمال البحارة وضمان الرعاية الطبية والضمان الاجتماعي وتدابير الوقاية من الحوادث التي أقرتها الاتفاقية الدولية للعمل البحري لسنة2006 و لأنه و بطبيعة الحال تفرض طبيعة العمل البحري تقديم خدمة طبية على متن السفينة لذلك يقع على عاتق المجهز الالتزام بعلاج البحارة وتوفير الرعاية الصحية اللازمة لهم ، فالمشرع الجزائري كرس للمرأة عدة حقوق في مجال العمل منها الحق في المساواة والسلامة الجسدية إضافة إلى الحق في التغطية الاجتماعية، إلا أنه لم يتوقف عند هذا الحد إنما أنشأ أجهزة إدارية وأخرى قضائية للحفاظ عليها أو استرجاعها في حالة التعدي عليها مما دفعنا الأمر للبحث عن فيما كان القانون البحري الجزائري أو غيره من الاتفاقيات الدولية وغيرها من الاتفاقيات ... إذ كانت أقرت للمرأة البحارة ضمانات قانونية و حماية اجتماعية خاصة تخص بها عن الرجل البحار فكان لابد من تقسيم المقال إلى ثلاثة مباحث في المبحث الأول الإطار التاريخي لإدماج العنصر النسواني في شتى ميدان القطاع البحري التجاري، في المبحث الثاني تطرقنا إلى الحماية الاجتماعية والصحية للمرأة البحارة . Abstract : The objective of this article is to investigate legal safeguards and health protection on board ships for seafarers, including seafarers "Women Maritimes" in accordance with maritime labour contracts, the most important of which is to guarantee the wages owed to seafarers and to ensure medical care, social security and accident prevention measures approved by the International Maritime Labour Convention for 2006. Women's rights in the field of employment are enshrined in Algerian legislation, including the right to equality and physical integrity, as well as the right to social coverage. However, it did not stop there but established administrative and judicial bodies to preserve or retrieve them in case of infringement, which led us to search for what was Algerian maritime law or other international and other conventions... Women seafarers have recognized special social safeguards and protection for men seafarers. The article has to be divided into three investigators in the first research. The historical framework for the integration of the feminist component in the various fields of the commercial maritime sector. In the second study, we have addressed the social and health protection of women seafarers.
