الملخص
تهدف هذه الدراسة إلى تحديد مفهوم القرارات الإدارية المنفصلة عن العقد و كيفية الطعن فيها سواء بالنسبة للمتعاقد مع الإدارة أو بالنسبة للغير مع تحديد أنواع هذه القرارات في مرحلة الإبرام وكذا مرحلة التنفيذ التي ثار فيها جدلا فقهيا كبيرا بين منكر لوجودها و معترف بها وبطبيعتها الخاصة التي تستلزم قبول الطعن فيها بصورة مستقلة عن طريق دعوى الإلغاء . وكذا مدى رقابة القضاء الإداري عليها من خلال دعوى الإلغاء This study aims to define the concept of administrative decisions separate from the contract and how to challenge them, whether for the contracting party with the administration or for others, with identifying the types of these decisions at the stage of conclusion as well as implementation. A stage in which a great jurisprudential controversy arose between denying its existence and acknowledging it and its special nature, which requires accepting the appeal independently through the case of annulment. As well as the extent to which the administrative judiciary censorship it through the annulment lawsuit
