تأثير الأزمات على تنفيذ الالتزامات التعاقدية في العقود الإدارية المستمرة

الملخص
الخواص تربطهم علاقات قانونية بالإدارة في شكل عقود إدارية ينظمها القانون العام، تتنوع بحسب الخدمة المراد تقديمها، وغالبا ما يكون تنفيذها مبني على أساس التراخي وهو ما يطلق عليها بالعقود المستمرة أو الزمنية أو عقود المدة؛ فيستغرق تنفيذها وقتا معينا قد يطول في غالب الحالات، ومن ثم فإنه كلما طالت مدة العقد كلما كان تغير الظروف أمرا محتملا، وبالنتيجة قد تكون الالتزامات العقدية عرضة لتأثير الأزمات والظروف التي لم تكن في الحسبان وقت ابرام العقد، فتفرز آثارا سلبية تؤدي الى اختلال التوازن المالي والاقتصادي للعقد، الأمر الذي يستدعي تفعيل النصوص القانونية القائمة، واتخاذ تدابير تنظيمية جديدة تتلاءم مع الظرف المستجد لمجابهة الازمة، سعيا للحفاظ على المراكز القانونية وحقوق المتعاقدين؛ سيما الطرف الضعيف في العلاقة.
